Won a chit prize but the payout is delayed? A Telangana consumer commission has upheld an order against Kapil Chits after holding the company responsible for delaying the payment of a Rs 15 lakh chit prize for more than 55 days. Kapil Chits attributed the delay to late submission of sureties, but the commission found the company records revealing otherwise.The dispute was not about the eligibility for the chit prize or whether the claimant had won the bid. The Commission had already accepted that he was the successful bidder. The question before it was how much time Kapil Chits could reasonably take to release the Rs 15 lakh prize amount the requirement for furnishing the necessary sureties was fulfilled.

Rs 15 lakh chit prize delay case: How the mobile shop owner won

The amount was payable to S. Eashwar, a mobile shop owner from Mahabubnagar who had emerged as the successful bidder in a Rs 25 lakh chit.S. Eashwar, a self-employed mobile shop owner from Mahabubnagar, had subscribed to a Rs 25 lakh chit run by Kapil Chits.The chit commenced in May 2018, and Eashwar was required to contribute Rs 50,000 every month for 50 months. He had joined the scheme with the intention of using the prize money to expand his mobile business.At the chit auction conducted on December 15, 2018, Eashwar emerged as the successful bidder after agreeing to forgo Rs 10 lakh. As a result, the prize amount payable to him was Rs 15 lakh.Eashwar subsequently submitted the four sureties sought by the chit company. Among those provided as sureties were three income-tax payers and a head nurse employed at a government hospital.Kapil Chits attributed the delay to Eashwar’s late submission of the required sureties, saying the documents had to be verified before the prize money could be released. The Telangana State Consumer Commission, however, found that the company’s own records showed the sureties had been submitted on March 28, 2019. It therefore concluded that the payment of the prize amount had been delayed by more than 55 days, according to an ET report.

Company said sureties were submitted late

The disagreement centred on the time taken by Kapil Chits to release Eashwar’s prize money.Kapil Chits maintained that Eashwar had submitted the required sureties only on April 28, 2019. According to the company, the documents first had to go through verification before the prize amount could be released, and the payment was ultimately made on May 18.The company further contended that, after the verification was completed, the delay was limited to five days. It said it had already paid Rs 1,100 as interest for this period.The Telangana State Consumer Disputes Redressal Commission, however, found that the company’s own records did not support this version of events.The Commission pointed to a document submitted by Kapil Chits showing that the sureties had in fact been furnished by Eashwar on March 28, 2019, a month earlier than the date claimed by the company.It also recorded that the final payment of Rs 13,00,375 was made only on May 25, 2019. Overall, Kapil Chits paid Eashwar Rs 14,85,000 in three separate instalments.

Commission finds more than 55-day delay

The Telangana State Consumer Commission noted that the Chit Fund Act does not lay down a specific deadline for a chit fund company to release the prize amount after receiving the required sureties.However, the absence of a prescribed time limit did not give the company the liberty to keep the payment pending indefinitely.The Commission held that even if seven days were allowed for verifying the sureties, the prize amount should have been paid by April 1, 2019.Instead, the final instalment was released only on May 25.The Commission consequently calculated the delay at more than 55 days and held that the payment had not been made within a reasonable period.It therefore concurred with the District Consumer Commission’s finding that the delay constituted a deficiency in service.

Rs 1,100 interest found too little

Kapil Chits defended its position by pointing out that it had already paid Rs 1,100 as interest for the delay in releasing the prize money.The State Commission, however, did not consider this amount sufficient in view of the length of the delay.It observed that calculating interest on the Rs 15 lakh prize amount at 12% per annum for a period of two months would result in an amount of around Rs 30,000.The interest actually paid by the company, at Rs 1,100, was substantially lower than this figure.The Commission consequently upheld the District Commission’s decision to grant Rs 25,000 as compensation for the delayed payment.

Rs 17,500 insurance amount also in dispute

Eashwar had raised another issue, alleging that Kapil Chits had deducted Rs 17,500 from his chit amount towards an insurance premium without obtaining his consent.The company disputed this claim, stating that the amount had subsequently been returned to Eashwar. It also relied on documents in support of its position.Despite this, the District Commission ordered Kapil Chits to refund the Rs 17,500. It also directed the company to pay Rs 25,000 as compensation for the delay and Rs 2,000 towards the costs of the proceedings.Kapil Chits then challenged the District Commission’s order before the Telangana State Consumer Commission.

Consumer commission upholds order

After reviewing the records and the submissions, the Telangana State Consumer Commission found no grounds to alter the District Commission’s decision regarding the delayed payment.The State Commission noted that the documents on record established that Eashwar had furnished the sureties on March 28, while the final payment was made only on May 25.It accordingly upheld the Rs 25,000 compensation awarded for the delay, along with Rs 2,000 towards litigation costs and the direction to refund Rs 17,500. Together, these amounts took the total monetary relief awarded to Eashwar to Rs 44,500.The Telangana State Consumer Disputes Redressal Commission, Hyderabad, passed the order on August 19, 2026.
